Port Klang Authority (PKA) has filed today a civil suit against Datin Paduka Phang Oi Choo (OC Phang), the former General Manager of PKA, for breaches of her fiduciary, contractual and common law duties to PKA.
PKA contends that she had failed to exercise due care, diligence and skill in the discharge of her duties as the General Manager of PKA by, amongst others, failing to comply with Treasury Guidelines, failing to ensure that key agreements entered into by PKA contain adequate terms necessary to safeguard PKA’s interest and appointing a quantity surveyor firm which was in a position of conflict of interest due to the firm’s association with Kuala Dimensi Sdn Bhd (KDSB), the turnkey developer of the PKFZ Project.
Further, OC Phang caused PKA to enter into further key agreements, which were not referred by her to the PKA Board Members for deliberation and approval, despite having full knowledge that such agreements would cause PKA financial distress as PKA was not in the position to finance the project at that point of time.
The financial predicament faced by PKA were also not addressed in an appropriate and prompt manner.
This suit is in addition to the earlier actions taken by PKA, including the criminal reports made against her to the relevant authorities.
